2018年9月1日,中国进行了第一次CRS金融信息交换。我们会发现美国并不在CRS之列,虽然如此,作为一个税务大国,美国有FATCA,那么他们两者之间有什么不同呢?

共同汇报标准 (CRS)
“共同报告准则”是一项国际协议,目的是交换税务方面的金融账户信息,以确定属于其他参与管辖区的税务居民的账户持有人。
共同汇报标准 (CRS) 是由经济合作与发展组织 (OECD) 及20国集团 (G20) 推出的,用于指导参与税务管辖区定期对税务居民财务户口资料进行交换的准则。
CRS是适用於财务机构的全球性资料收集及汇报要求,旨在提升税收透明度和打击跨境逃税问题。政府要把那些隐藏在天涯海角的流失的税款收归国库。美国虽然不是CRS 的成员国,但美国早在2014年就先行一步,有了FATCA(肥咖条款), 而CRS 基本上FATCA 的扩大版。
"肥咖条款"FATCA要求全球金融机构向美国通报美国人在海外的金融资料,以供美国政府查税。

1) Entities participating information exchange:
覆盖的海外机构
All overseas financial institutions, including: banks, trusts, brokers, insurance companies and all investment entities that provide financial products.
所有的海外金融机构,包括:银行,信托,券商,保险公司以及所有提供金融产品的投资实体。
2)Asset information to be exchanged
覆盖的资产信息
Deposit accounts, escrow accounts, funds, stocks, annuity contracts, insurance contracts with cash values, etc.
存款账户,托管账户,基金,股票,年金合同,有现金值的保险合同等。
3)Personal information to be exchanged
覆盖的个人信息
Account number, account balance, account name, date of birth, age, gender, residence address.
你的账户,账户余额,姓名,出生日期,年龄,性别,居住地址。
4) CRS exchange process
CRS 交换流程
Non-resident information → financial institutions → national tax authority →national tax authorities will exchange the information with other CRS member countries
非居民的信息 → 金融机构→ 国家税务机关→ CRS 成员国的国家税务机关互换。
Under CRS, The old-fashioned approach to avoid tax is no longer feasible. Therefore, a tax planning becomes more important than ever not only for wealthy investors, also for everyone with oversea financial assets.
CRS 的背景下,老式的利用国家之间信息屏蔽而达到少交税或不交税的方法不再可行。 政府一方面要收到该收的税收,另一方面,政府更想吸引投资,增加就业……所以,鼓励性的税收政策各国都有,只要提前规划,合理避税还是有很多空间。

税务规划不但是富裕阶层的投资决策前的优先考虑,对所有拥有海外金融资产人士也变得日渐重要了。
